Decree on Tariffs Paid by Microcredit Organizations to the Banking Agency of the Federation of BIH

This Decree stipulates the amount of tariff and the manner of paying the tariff for carrying out the supervision and control of business operations of microcredit organizations (MCO), as well as other tariffs that MCOs are obliged to pay to the Banking Agency of the Federation of BiH (FBA). The Decree states that the Director of the MCO and the Management Board are responsible for regular payment of tariffs for duties that the FBA carries out. The tariffs are of various kinds and include:

  • Tariffs for carrying out the supervision and control of MCOs business operations, such as linear annual tariffs and quarterly variable portions.
  • Tariffs for issuing permits, approvals, consents, certificates, which include tariffs for:
    • Issuing approval for changing the organizational form of the MCO;
    • Establishing business operations of a microcredit foundation (MCF) with headquarters outside Bosnia and Herzegovina;
    • Issuing permit change of MCO;
    • Establishing the organizational parts of the MCO;
    • Issuing the approval on founding enactments of the MCO;
    • Issuing other permits, approvals and opinions;
    • Issuing certificates and notarizations.

The Decree also states that in case the profit from the tariffs paid to the FBA exceeds the cost of carrying out supervision of the MCOs business operation, the FBA management may decide to return a portion of the funds to the MCO. The Decree shall come into effect on the eighth day after its publication in the Official Gazette of the Federation of Bosnia and Herzegovina. It is signed by the President of the Management Board.
